Darul Ifta Kauzariyya: Center for Excellence in Islamic Jurisprudence

I. Introduction

Allah (SWT) says in the Holy Qur’an:

{ ۞ فَلَوۡلَا نَفَرَ مِن كُلِّ فِرۡقَةࣲ مِّنۡهُمۡ طَاۤىِٕفَةࣱ لِّیَتَفَقَّهُوا۟ فِی ٱلدِّینِ وَلِیُنذِرُوا۟ قَوۡمَهُمۡ إِذَا رَجَعُوۤا۟ إِلَیۡهِمۡ لَعَلَّهُمۡ یَحۡذَرُونَ }
[At-Tawbah: 122]
Meaning: “So why should not a party from every group of them go forth that they may apply themselves to the study of Religion and that they may warn their people when they come back to them that they may be cautious?”

In fulfillment of this divine command, Al-Jamiathul Kauzariyya established the Department of Specialization in Fiqh and Ifta. This department serves as a premier academic hub for advanced studies in Islamic Law and the authoritative issuance of legal rulings (Fatwas) to the community.

II. Academic Program: Specialization in Ifta (Fatwa Studies)

The objective of this department is to produce a generation of scholars capable of deriving jurisprudential rulings from primary sources to address contemporary challenges.

1. Curriculum & Methodology

  • Classical Training: Intensive training on writing Fatwas by referencing authoritative texts of Hanafi and Shafi’i Fiqh (e.g., Fatawa Shami, Badai al-Sanai, Al-Majmu’, Tuhfat al-Muhtaj).
  • Legal Maxims: Mastering “Qawaid al-Fiqhiyyah” through classical works like Mawsu’at al-Qawaid and Al-Ashbah wa al-Nazair.
  • Practical Training: A two-year intensive program where students handle 200 cases in the first year and 50 complex cases related to Financial Transactions (Muamalat) in the second year.

2. Research and Writing

  • Contemporary Issues: Students publish annual research papers on modern topics such as Gender Reassignment, Imported Meat Regulations, and Health Insurance.
  • Instruction: The medium of instruction is strictly Arabic. Selected researchers are provided with a monthly scholarship (Stipend).

III. The Fatwa Board: Public Services

Darul Ifta Kauzariyya acts as a trusted guide for the community regarding all Shariah-related matters.

1. Core Services

  • Jurisprudential Consultation: Resolving doubts regarding general Islamic legal matters.
  • Islamic Finance: Guidance on Shariah-compliant business and banking transactions.
  • Matrimonial Services: Pre-marital and post-marital counseling, and rulings on Divorce (Talaq) and Khul’a.
  • Inheritance: Accurate calculation and distribution of estates according to Islamic Law.
